Preamble
Newmeet is an online dating service. Please read these terms of use carefully. By creating an account on Newmeet, you fully and unreservedly accept all of these terms. If you do not accept them, you must not register.
By ticking the box "I have read and accept the terms of use" during registration, the Member acknowledges being fully informed and bound by all of these provisions.
Article 1 — Access and registration
1.1 Right of access. The equipment and telecommunication costs required to access the service are borne solely by the Member. To become a Member, you must be at least 18 years old and complete the mandatory fields of the registration form.
The Member warrants that the information provided is accurate and undertakes to keep it up to date from their personal area. Logins and passwords are strictly personal and confidential. Newmeet cannot be held liable for their loss or misuse by a third party, except through its own fault. The Member must inform Newmeet without delay of any suspicious use of their account.
Newmeet reserves the right to deactivate accounts inactive for 6 months or more (counted from the last valid login).
1.2 Right of withdrawal. In accordance with consumer law, the Member has fourteen (14) days to exercise their right of withdrawal on a paid subscription, without penalty or reason. This right may no longer be exercised once the Member has started using the paid service before the end of that period, with their express consent.
Article 2 — Use of the service
Once registered, the Member has access to the available services and undertakes in particular to:
- comply with applicable laws and respect the rights of third parties;
- not use Newmeet for professional, commercial, soliciting or prostitution purposes;
- only publish information that is truthful;
- not post defamatory, insulting, obscene, violent, racist, xenophobic or indecent content; photos and information provided must be decent and relate exclusively to the Member;
- not share any personal contact details (email, address, phone) allowing contact outside Newmeet;
- not disrupt the service (spam, viruses, mass mailing, etc.);
- not share links to unlawful sites or sites contrary to the purpose of Newmeet.
In the event of a breach, Newmeet reserves the right to remove the disputed content and to block or terminate the account concerned, temporarily or permanently, without compensation or refund. Newmeet declines all liability for meetings between Members. For a first meeting, it is recommended to inform a relative and to choose a public place.
Article 3 — Price and payment terms
Registration and basic use of Newmeet are free. Some optional services may be paid; where applicable, their prices (in euros, all taxes included) and terms are clearly indicated on the site before any subscription.
Access to a paid service opens upon validation of the transaction. The Member may cancel an optional subscription at any time; cancellation takes effect at the end of the current period. Unless cancelled beforehand, a subscription may renew for one-month periods, billed on the same basis, cancellable at any time with effect at the end of the current monthly period.
Article 4 — Privacy and data protection
Newmeet processes its Members' personal data in compliance with the General Data Protection Regulation (GDPR).
Certain optional information (photo, etc.) may reveal so-called "sensitive" data (origin, religion, sexual orientation). By providing it, the Member expressly consents to its processing by Newmeet and assumes responsibility for it.
The information collected is used to provide the service and is stored in a secure environment. Data that does not form part of the Member's public profile is not transferred or sold to third parties without consent. Information forming the profile, search criteria and presentation (excluding email, phone, address and password) is published on the site to increase the chances of meeting people.
In accordance with the GDPR, each Member may at any time access, rectify, delete, object to the processing of, or request the portability of their data, from their personal area or by writing to info@newmeet.com.
Article 5 — Intellectual property
The trademarks, logos, graphics, photographs, videos and texts on the Newmeet site are the intellectual property of Newmeet and may not be reproduced or used without express authorisation, under penalty of prosecution.
The rights granted to the Member are limited to accessing and using the service for private and personal use, for the duration of their membership. Any other use (copying, reproduction, distribution, commercial exploitation) is prohibited without Newmeet's authorisation.
Article 6 — Termination
The Member may cancel their registration at any time and without reason from the dedicated area of the site. Where an optional subscription is in progress, cancellation takes effect at the end of the corresponding period.
In the event of a breach of these terms, Newmeet may issue a warning, suspend or terminate the account after formal notice by email. In the event of a serious breach (identity theft, illegal trade, paedophilia, prostitution, minor's account, spam, fraud), termination may occur without notice. The Member is informed by email. Their data is deleted on request or upon expiry of the legal limitation period.
Article 7 — Liability and warranty
7.1 Content provided by Members. Information provided by a Member must be accurate; the consequences of its disclosure are their sole responsibility. Newmeet cannot be held liable for the accuracy of content published by Members or for the consequences of meetings. Newmeet uses moderation measures and promptly removes any manifestly unlawful content brought to its attention.
7.2 Operation of the service. The Member must have suitable equipment and connection. Given the nature of the Internet, Newmeet does not guarantee operation without interruption or error; the service may be temporarily suspended for maintenance or upgrades. Newmeet is not liable for malfunctions related to the Member's equipment, their access provider or the network. Inbox messages are kept for a limited time; it is recommended to back up those you wish to keep.
7.3 Links. The site may link to third-party sites governed by their own terms. Newmeet removes any link to unlawful content as soon as it becomes aware of it.
Article 8 — Agreement on evidence
These terms, together with the pages of the site to which they refer, constitute the contract governing relations between the Member and Newmeet. They cancel and replace any prior provision and constitute the entirety of the parties' rights and obligations.
Article 9 — Changes
Newmeet reserves the right to change the service and these terms at any time. Any change is brought to the Member's attention, who has a period to terminate if they do not accept it, under the conditions of Article 6.
Article 10 — Governing law and jurisdiction
These terms are governed by French law. In the event of a dispute, and failing an amicable settlement, the competent French courts shall have jurisdiction.
